Max Network reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Max Network's sole discretion.

Always use caution when giving out any personally identifying information about yourself or your children in any Communication Service. Max Network does not control or endorse the content, messages or information found in any Communication Service and, therefore, Max Network specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. Managers and hosts are not authorized Max Network spokespersons, and their views do not necessarily reflect those of Max Network.

Max Network reserves the right, in its sole discretion, to terminate your access to the Max Network Web Site and the related services or any portion thereof at any time, without notice. GENERAL To the maximum extent permitted by law, this agreement is governed by the laws of the State of Michigan, U.S.A. and you hereby consent to the exclusive jurisdiction and venue of courts in Wayne County, Michigan, U.S.A. in all disputes arising out of or relating to the use of the Max Network Web Site. Use of the Max Network Web Site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Max Network as a result of this agreement or use of the Max Network Web Site. Max Network's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Max Network's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Max Network Web Site or information provided to or gathered by Max Network with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Max Network with respect to the Max Network Web Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Max Network with respect to the Max Network Web Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent an d subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be drawn up in English.

All Max Network members agree to maintain their subscription and have rights and access to all products, services, and training materials.

All subscribers recognize that the credit card they have on file will continue to be billed every 30 days until that subscriber cancels his/her subscription with Max Network.

There is no long term commitment or timeframe in which a subscriber must continue to remain active by paying their monthly subscription fee. Subscribers may cancel their subscription at any time for any reason simply by logging into their Max Network members area and clicking on the support section or contact us section where they are required to follow the “Cancel Subscription” link to cancel their subscription. No commissions can be earned by inactive subscribers.

Max Network maintains a 3 day 100% refund policy. You must cancel your subscription within 3 days of upgrading to “paid subscriber” to be eligible for a refund. After you have been a subscriber for 3 days, no refunds either partial or full are given.

The same 3 day policy applies to the monthly subscription payment. You can cancel your subscription within 3 days of the most recent charge and be eligible for a refund for that month's subscription fee only. After 3 days, no refunds either partial or full are given.

Refunds are only given if the 3 day eligibility requirement is met and if the refund is requested. To request a refund, you must send an email through a support ticket from http://www.maxous.com/imax/ticket/ including your username or ID number.

In order to protect our subscribers and ensure the long term growth and success of Max Network, we maintain a ZERO tolerance policy towards the sending of spam email. Spam email is defined as Unsolicited Commercial Email (UCE). In the event that you send spam email to people without their permission, you risk immediate cancellation of your account and forfeiture of all contacts in that account. As a Max Network subscriber, you understand that Max Network neither condones nor tolerates the sending of unsolicited or spam email by its subscribers. You understand and acknowledge that:

It is ILLEGAL to forge headers on emails and it is ILLEGAL to neglect to include a valid functional unsubscribe link along with a valid mailing address in any emails sent out. Anyone caught forging headers or not including a valid functional unsubscribe link will be immediately and permanently terminated from Max Network. Max Network also prohibits all subscribers from including the name or website address in any emails they send out. Subscribers are required to use a redirect link when directing prospects to their landing page.

We also require all subscribers to download their list of email addresses that have generated a complaint that can be found in the Spam Policy link in the subscribers section of the Max Network website and permanently remove them their your database. If we receive a complaint from the same email address as a previous complaint from an email that was sent more than a week after the original complaint was filed, Max Network has the right to terminate your subscription. You are solely responsible for mail sent on your behalf.

Max Network will immediately terminate your subscription and suspend all future commissions for violating these Spam Policies. Max Network reserves the right to take legal action against any subscriber found violating this Spam Policy. You will not be eligible for a refund if you are terminated for violating the Max Network Spam Policy.

Max Network monthly subscription fee is to pay for full access to the consumer benefits and educational material provided by Max Network and its trainers. All active subscribers may also participate in the Max Network compensation program as outlined on the Pay Plan page of the website.

Commissions are paid as outlined on the Pay Plan page of the website. All subscribers understand BEFORE paying their subscription fee that there are NO GUARANTEED EARNINGS. Subscribers understand that the Marketing Techniques or Training are not to reflect earnings, but to be a representation of company growth and does not mean anything in terms of commissions.

Subscribers should not participate in Max Network under the expectation of earning income without referring new subscribers. Neither Max Network, nor its subscribers can guarantee "spillover" or earnings simply by becoming a subscriber. Max Network subscribers are purchasing consumer benefits and training products to educate them in the industries outlined on the Services and Opportunity pages. Subscribers should not participate in Max Network if they are not planning on using the member benefits, nor if they are not planning on sharing the opportunity with others.

Most subscribers earn less money each month in the compensation program than they are paying to maintain their subscription in Max Network. Although it is possible, Max Network subscribers should NOT expect to make a profit simply by becoming a subscriber as it is highly unlikely that will occur.

Max Network cannot guarantee that subscribers earn a profit by implementing the training materials provided and sharing the consumer benefits.

No subscriber should spend money that they cannot afford to lose to become a subscriber and maintain their subscription in Max Network. It is possible that you will NOT earn income as a subscriber of Max Network.

Max Network may change, alter, add, or detract conditions of subscription, products, services, and compensation at any time and for any reason and WITHOUT NOTICE to members.  Max Network reserves the right to terminate a subscriber at any time for violating any of our policies regardless of fault.

All disputes and claims relating to Max Network, this Agreement, the Max Network compensation plan, or its products, the rights and obligations of a Representative and Max Network, or any other claims or causes of action relating to the performance of either a Representative or Max Network under the Agreement or the rules and regulations, and/or a Representative's purchase of products shall be adjudicated totally and finally in the state of Michigan, or such other location as Max Network prescribes.

Max Network and its affiliates, officers, directors, employees, and other representatives shall not be liable for, and the Representative hereby releases the foregoing from and waives any claim for loss of profit, incidental, special, consequential, or exemplary damages which may arise out of any claim whatsoever relating to Max Network performance, non-performance, act, or omission with respect to the business relationship or other matters between the Representative and Max Network whether sounding in contract, tort, or strict liability.
